how would i go about doing that or do i have to hiring a lawyerI would like to know if i can sue the public defender office for ineffective representation and bad advice.?
Technically, it is possible to sue almost anyone, but that's not your question, really. Your question is whether it is worth the filing fee; can you win? And for that, you need to tell the details to a liability attorney and see if they are willing to take the case on contingency fee. If you have a complaint but can't find a lawyer willing to gamble his time and expertise to winning it, then it's probably because none of the ones you spoke to think it has much chance of winning.
One thing is in order to win a liability case, you have to be able to prove damages. What, exactly, did you lose? You will need documentation, of course.
So go ahead and try. Visit with several plaintiffs' attorneys and see if they will take you up on it.I would like to know if i can sue the public defender office for ineffective representation and bad advice.?
First of all you would have to have specific damages. I am not sure you can come up with a monetary amount of damage for bad advice or poor representation? Secondly, I'm not sure that suing an office full of lawyers is a good idea.
It would be difficult at best.
Yes, but I think you'd have to hire a lawyer.
Dear Friend,
Generally speaking, public officials have qualified immunity from civil suit. That means you can only sue them on allegations that they intentionally harmed you. What you're describing is mere negligence, sloppy lawyering. That is not enough to sue a public official, like a public defender. Save your money.
Your Friend,
Francesois
You can claim a mistrial, on grounds of misrepresentation, but no you cannot sue your public defender. Think about it...they're paid to lose.
